These Terms and Conditions govern your access to and use of the website, application, content, data, alerts, emails, tools, and related services offered by Axiom Data Solutions, LLC, doing business as SeasonalTrading.com (“Seasonal Trading,” “Company,” “we,” “us,” or “our”).
By accessing, subscribing to, purchasing, or using SeasonalTrading.com or any related services, you agree to be bound by these Terms and Conditions. If you do not agree, do not access or use the service.
You must be at least 18 years old and legally capable of entering into a binding agreement to use the service.
Seasonal Trading provides educational market research, historical seasonal analysis, tools, alerts, dashboards, data views, email content, model outputs, and related informational services. All services are offered for informational and educational purposes only.
Seasonal Trading is not a registered investment adviser, broker-dealer, commodity trading advisor, or fiduciary. Nothing on the website, in the app, in emails, in chat, in alerts, or in any other content should be construed as personalized investment, legal, tax, or financial advice. Any information provided is impersonal, general in nature, and not tailored to your specific financial situation. You are solely responsible for your own trading and investment decisions. You should consult a licensed financial professional before making any investment or trading decision.
Trading and investing in stocks, ETFs, options, futures, forex, cryptocurrencies, and other financial instruments involves substantial risk. Past performance, historical patterns, seasonal trends, and hypothetical or backtested results do not guarantee future results. You may lose some or all of your capital. Seasonal patterns can fail, break down, or change without warning. You acknowledge that you use the service entirely at your own risk.
Seasonal Trading currently offers subscription plans including a monthly plan ($29/month) and an annual plan ($297/year), each beginning after any applicable free trial period. Pricing, plan structure, and features may change at any time. By subscribing, you authorize us and our payment processor to charge your selected payment method for all applicable fees, taxes, and recurring charges until canceled.
You may cancel your subscription at any time through your account, billing portal, or by contacting us. Cancellation stops future renewal charges but does not retroactively cancel or refund charges already incurred. All subscription fees are non-refundable once charged, except where required by law. No prorated refunds will be issued for unused time. If you cancel, you will generally retain access through the end of your current paid billing period.
If a free trial is offered, you may use the service during the stated trial period. Unless canceled before the end of the trial, your subscription will automatically convert into the selected paid plan. We reserve the right to modify, withdraw, limit, or deny free trials at any time.
You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account. You may not share, resell, sublicense, or distribute access to your account. We may suspend or terminate any account that we believe is being shared, abused, scraped, resold, or used in violation of these Terms.
All content, software, branding, text, graphics, charts, datasets, alerts, emails, code, design elements, models, outputs, and site functionality are owned by or licensed to Axiom Data Solutions, LLC and are protected by applicable intellectual property laws. Your subscription grants you a limited, revocable, non-exclusive, non-transferable license to use the service for your own personal or business use. You may not copy, reproduce, redistribute, scrape, reverse engineer, sell, or repackage the service or its content.
You agree not to use the service for unlawful purposes; interfere with servers or security features; attempt unauthorized access; use bots, scripts, or scrapers except where expressly authorized; impersonate others; or use the service in a way that could damage or impair the platform.
We strive to provide useful and timely information but do not guarantee accuracy, completeness, timeliness, or availability of any data, chart, alert, signal, or content. Data may contain errors, omissions, delays, or calculation inconsistencies. We may modify, suspend, or discontinue any part of the service at any time.
The service is licensed for educational and informational use. If you choose to use any information for actual trading or investing, you do so solely at your own risk. You are responsible for verifying symbols, liquidity, timing, order handling, fills, spreads, commissions, slippage, taxes, and any other considerations before acting.
The service may use or link to third-party tools, data vendors, payment processors, analytics services, charting libraries, or external websites. We are not responsible for any third-party products, services, content, or policies.
Your use of the service is also subject to our Privacy Policy. We do not sell your personal information to advertisers.
If you voluntarily submit feedback, reviews, or testimonials, you grant us the right to use them for business and marketing purposes, unless you explicitly request otherwise in writing.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. THE COMPANY DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF DEFECTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AXIOM DATA SOLUTIONS, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, TRADING LOSSES, OR INVESTMENT LOSSES. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU DURING THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
You agree to defend, indemnify, and hold harmless Axiom Data Solutions, LLC from any claims, liabilities, damages, losses, costs, and expenses arising from your use or misuse of the service, violation of these Terms, violation of any law, or your trading or investment activity based on the service.
We may suspend, restrict, or terminate your access at any time if we believe you have violated these Terms, abused the platform, failed to pay fees, or engaged in harmful conduct. Termination does not relieve you of payment obligations.
We may update these Terms from time to time. Updated Terms become effective when posted. Your continued use constitutes acceptance. We may also modify, replace, or discontinue any feature or part of the service at any time.
These Terms shall be governed by the laws of the state in which Axiom Data Solutions, LLC is organized. Any dispute shall be brought exclusively in the state or federal courts located in that state.
At the Company’s election, disputes may be resolved by binding arbitration instead of in court, except for small claims and IP-related injunctive relief. You agree that any claim will be brought only in your individual capacity and not as part of a class action.
If any provision is found unenforceable, the remaining provisions remain in full force.
These Terms, together with the Privacy Policy and any checkout terms, constitute the entire agreement between you and the Company regarding the service.
